Welcome to ChooseMy.Food! These Terms of Service ("Terms") govern your access to and use of the ChooseMy.Food website at choosemy.food and our random restaurant picker service (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

• Randomly selecting a restaurant or dining establishment from available options within the specified parameters
• Displaying restaurant information including photos, ratings, hours, contact details, and directions
• Utilizing Google Places API and Google Maps for restaurant data and navigation

The Service is provided "as is" and free of charge. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. Eligibility and User Requirements

3.1 Age Requirement

You must be at least 13 years of age to use ChooseMy.Food. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms.

3.2 Technical Requirements

To use the Service, you must have:

• A compatible web browser with JavaScript enabled
• An active internet connection
• For location detection features: device GPS or location services enabled

4. Acceptable Use Policy

You may use ChooseMy.Food for lawful, personal, non-commercial purposes to find dining recommendations.

• Infringe upon the intellectual property rights of ChooseMy.Food or third parties
• Upload, transmit, or distribute any viruses, malware, or malicious code
• Impersonate any person or entity or falsely state your affiliation with any person or entity
• Collect or harvest personal information about other users

We reserve the right to terminate or suspend your access immediately, without prior notice or liability, if you breach these Terms.

All content, features, and functionality of the Service, including but not limited to:

are owned by ChooseMy.Food or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.3 Third-Party Content

Restaurant information, photos, ratings, and other content are provided by Google Places API and are subject to Google's terms of service. We do not own or control this third-party content.

Our Service integrates with Google Places API and Google Maps. Your use of these services is subject to:

6.2 External Links

The Service may contain links to third-party websites or services (restaurant websites, review sites, etc.) that are not owned or controlled by ChooseMy.Food. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that ChooseMy.Food shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

7. Disclaimers

7.1 "AS IS" and "AS AVAILABLE" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content or information

7.2 Restaurant Information Accuracy

We rely on Google Places API for restaurant information. We do not guarantee the accuracy, completeness, or timeliness of:

• Restaurant names, addresses, or contact information
• Hours of operation (restaurants may be closed, have changed hours, or gone out of business)
• Ratings, reviews, or photos
• Menu items, prices, or availability
• Special dietary accommodations or allergen information

ALWAYS verify critical information (hours, reservations, menu options, dietary restrictions) directly with the restaurant before visiting.

7.3 Location-Based Services

Location detection may be inaccurate due to GPS limitations, network issues, or device settings. The Service may not function properly if location services are disabled or unavailable.

7.4 No Restaurant Endorsement

The random selection of restaurants does not constitute an endorsement, recommendation, or guarantee of quality by ChooseMy.Food. We do not have relationships with, receive compensation from, or control the operations of any restaurants displayed in search results.

7.5 Dietary and Allergy Disclaimer

ChooseMy.Food does NOT provide medical or dietary advice. If you have food allergies, dietary restrictions, or medical conditions:

• Always verify menu options and ingredients with the restaurant directly
• Inform restaurant staff of your specific needs and restrictions
• We are not responsible for any adverse reactions or health issues resulting from dining at recommended establishments

8. Limitation of Liability

8.1 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHOOSEMY.FOOD, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury, property damage, or other damages
• Damages arising from your use or inability to use the Service
• Damages resulting from dining experiences at recommended restaurants
• Damages caused by errors, omissions, interruptions, defects, delays, or security breaches

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.2 Maximum Liability Cap

If, notwithstanding the above, we are found liable for any damages, our total liability shall not exceed the amount you paid to use the Service (which is $0, as the Service is free).

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.

14.3 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@choosemy.food. We'll try to resolve the dispute informally within 30 days.

14.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action or class-wide arbitration.

15. Miscellaneous Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ChooseMy.Food regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by us.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and ChooseMy.Food as a result of these Terms or your use of the Service.

15.6 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, internet outages, or government actions.

The section headings in these Terms are for convenience only and have no legal or contractual effect.
